The aims of the Regulation are to ensure the safe use and formulation of products intended for use as biocides and to remove substances deemed to pose a significant risk, from the European market place. Each active substance must be approved for each application (Product Type) and the target is to have biocidal products in the market that are effective and efficient, but also safe for the user.
The adoption of the Regulation now mean that with effect from 1st September 2015, only approved active substances can be used in biocidal products and these should be purchased from suppliers on the approved list as defined under Article 95 of the regulation.
Brenntag is very closely involved in the successful and smooth implementation of the regulations, in particular through our participation in the Eurochlor group seeking approval for Chlorine, Sodium Hypochlorite and Calcium Hypochlorite, where we are a key UK producer. We are also in very close contact with manufacturers of other active substances to understand their plans under Article 95. From this we will understand those active substances that will be marketed as biocides and those which will solely be offered as chemicals. From this, Brenntag will assess customer requirements and act accordingly to ensure ongoing supply of raw materials or alternative compliant options.
The regulations may require changes in labelling which we will be introducing across relevant biocidal products once the final requirements are confirmed.
What should you do now?
If you are formulating or placing biocidal products on the market you need to ensure you are buying the active substances from approved suppliers listed on Article 95, by 1st September 2015. Thereafter, authorisation will be needed for your biocidal product and you will need to request access to the dossiers that have been or will be completed for the actives. We will be able to offer this directly for certain product groups and would welcome further discussions on your interest in this option.
